TERMS AND CONDITIONS
Toby’s Estate Coffee Asia Pte Ltd services are hired by the customer under the following terms and conditions. (applicable only within mainland Singapore). For export purposes, please contact the sales personnel at the undersigned.


ORDER ACCEPTANCE

1. All orders must be placed at least 2 working day in advance before 11.00 am for delivery by phone,email or by faxing the
order to Toby’s Estate for a minimum order of $100.00 per delivery. Faxed orders will be confirmed only by phone.
1a. Subjected to $20 transportation fee for delivery order less than $100.
2. Orders must be placed before 12.00 noon on Friday for delivery on Monday. There is no order acceptance on Saturdays,Sundays and Public Holidays.
3. Late orders will only be fulfilled at the sole discretion of Toby’s Estate.
4. No order is considered binding until it is officially confirmed by a duly authorised representative of Toby’s Estate.
5. It is the sole responsibility of the customer to ensure that all orders placed in their name are authorized and correct.
6. All deliveries must be checked and signed by the customer at the time of delivery. The customer’s signature and the company stamp shall be deemed to be an acknowledgment and acceptance by the customer for the delivery of a complete order. If any part of the order is rejected without any good reason, Toby’s Estate reserves the right to bill the customer for it.


DELIVERY

1. There is no delivery on Saturdays, Sundays and Public Holidays.
2. Every effort is made to deliver goods as early as possible. However, no delivery times are guaranteed.
Toby’s Estate will ensure that the customer is fully informed of any delays due to circumstances beyond their control.
3. Cancellation of a confirmed order is not allowed on the day of the delivery.


PAYMENT TERMS

1. All payments are strictly cash on delivery basis in Singapore Dollars (S$) at the time of delivery until a credit application is approved by Toby’s Estate. Toby’s Estate reserves the right to reject any credit application without any reason given.
2. All prices are subjected to the 7% Goods & Services Tax (GST) at the prevailing rate and prices may change without prior notice.
3. If the credit application is approved, Toby’s Estate reserves the right to charge interest from the due date at the rate of1% per month, on the outstanding amount more than 30 days after the due date for payment.
4. Toby’s Estate reserves the right to change credit terms at any time. Any customer with a past due balance over 60 days will be suspended from further orders and deliveries until account is paid in full and current.


PRODUCTS AND STORAGE

1. All coffee products from Toby’s Estate are handcrafted and roasted on demand. Whilst every effort will be made to maintain the consistency, the roast level of the products may still vary slightly.
2. If any product is not satisfactory, please notify Toby’s Estate within 24 hours. A replacement product or credit note will be issued once the product is returned to Toby’s Estate.
3. Due diligence will be transferred to the customer at the time of delivery to ensure that the products supplied are maintained in appropriate storage conditions prior to its consumption and thereafter. Toby’s Estate cannot be held responsible for any deterioration or damages of the products supplied after the time of delivery.
